Ex-Playful Painters Childcare Employee Charged with State, Federal Child Sex Crimes

A former employee of Playful Painters Childcare in Lincoln, Nebraska is facing federal child pornography charges and state child sexual assault charges related to his work at the daycare. Titus Miller has been charged with four counts of sexual assault of a child – two in the first-degree and two in the third-degree.

Miller was first arrested on October 22 following an FBI investigation. Federal authorities say he allegedly sexually assaulted at least four children and produced videos and photos of the alleged abuse. The alleged abuse is believed to have occured between July and September of this year.

State prosecutors filed child sexual assault charges against Miller on Tuesday, October 29.

Miller appeared in U.S. District Court last week on the federal charges, which involve the production and distribution of child pornography. If convicted on those charges, he could face 20-50 years in federal prison. No court date has been set for the state charges.

Miller had been working at the 24-hour daycare as a night manager since 2016. Playful Painters Child Care offers childcare services for children between the ages of 6 weeks and 12 years old. The daycare has been shut down as a result of this investigation.

Legal Options For Families Affected by Daycare Sex Abuse

Attorney contributor and former sex crimes prosecutor Brian Kent of AbuseGuardian.com helps sex abuse victims and their families find justice in civil lawsuits. Brian has offered to add some thoughts on the legal options available to daycare sex abuse victims and their families:

Parents trust daycares to keep their children safe above all else. In this field and others that involve working with children, it’s paramount to make sure all employees are trustworthy people and that the children under the daycare’s watch are protected from the threat of sexual abuse. When a daycare employee is arrested for sexually abusing children, there are several troubling concerns that should be addressed – including whether the abuse was preventable.

In many daycare sex abuse cases, the abuse may have been preventable if not for negligence by the facility. For example, a daycare could be considered negligent if they had inadequate safeguards in place which could have prevented the abuse – such as not allowing employees to be alone with children. In cases of negligence, daycare sex abuse victims and their parents may have grounds for a lawsuit against the daycare.
