Legal Recourse For Victims Injured in Parking Lot Shootings

Attorney contributor Brian Kent of CrimeVictim.Attorney works closely with victims and their families who have been injured or killed in parking lot shootings. Mr. Kent has generously shared with us his insight on the legal options open to these victims.

“Essentially, commercial property owners have a legal duty to protect their patrons and employees from any preventable hazards. Providing adequate security is how these owners can fulfill this legal duty. Adequate security may include things like installing video surveillance and hiring security guards. If a property owner fails to provide adequate security on site, and a shooting occurs due to their negligence, then he or she may be held liable for the crime,” explains Mr. Kent.

He continued: “In order for a property owner to be held liable for violent crime on their property, the crime must be deemed reasonably foreseeable in addition to the inadequate security. For instance, if a shooting occurs at a parking lot with a previous history of violent crime, yet no security improvements were established, then the crime may be considered reasonably foreseeable. Therefore, a violent crime victim’s lawyer must be able to prove that the crime occurred due to negligent security, and that it was reasonably foreseeable.”

If you or someone you love has been injured or killed in a parking lot shooting, you can learn more about the legal options available to you by discussing your case with an experienced crime victim attorney.
