Legal Recourse For Nursing Home Sexual Assault Victims & Their Families
Attorney contributor Brian Kent of AbuseGuardian.com represents victims of sexual abuse in civil lawsuits. Brian has some general information to add regarding the legal rights of nursing home sexual assault victims and their families:
Nursing homes and rehabilitation centers have a legal duty to make sure their residents and patients are safe from preventable dangers. These residents deserve respect and their families deserve to know that their loved ones are safe. Sadly, this field has a high potential for abuse and jobs in this field are often sought after by predators who seek to exploit their authority and abuse residents under their care.
When a nursing home resident comes forward with allegations of sexual assault involving a staff member, there are several issues to consider. The accused must be investigated and prosecuted, but the investigation doesn’t always end in criminal courts. The facility should also be investigated to determine if negligence played a role in allowing the assault to happen.
For example, a nursing home could be considered liable for a sexual assault of a resident if the facility failed to run background checks before hiring new employees.
If you or a loved one has been sexually assaulted in a nursing or rehab center, you can learn more about your legal rights by speaking with an experienced sexual assault victims attorney.
