Aldine ISD Teacher Released on Bond Following Child Sexual Assault Arrest

A teacher from Aldine Independent School District has been released on bond after being arrested on charges of child sexual assault, according to ABC 13. Derrick Banks, 39, who serves as an agriculture teacher at Eisenhower High School, located at 7922 Antoine Dr Room 701, Houston, TX 77088, faces serious allegations stemming from incidents that occurred over the past few years.

Sexual Assault Allegations and Timeline of Arrest of Teacher

Court records reveal that Banks had two outstanding warrants for first-degree felony offenses of aggravated sexual assault of a child under 14 for the past two years. His arrest at the end of October came two years after the initial warrant was issued in October 2023. The investigation, which began in 2021, alleges that Banks met a 13-year-old boy through an app and subsequently engaged in inappropriate actions.

According to the documents, the boy sneaked out to meet Banks, who allegedly took him to a remote location in Sugar Land. It is reported that Banks blindfolded the boy before bringing him into his home.

Background Checks and Employment Status

At the time of the alleged offenses, Banks was employed at Prairie View A&M University. Aldine ISD confirmed that he started working in the district in August 2023 and passed all hiring procedures, including a criminal background check. The district asserted they were unaware of any warrants against Banks prior to his arrest, having received no notifications from the Harris County District Attorney’s Office or the Houston Police Department. Following the arrest, Banks has been placed on administrative leave.

Concerns Raised Over Delayed Arrest

Retired Houston Police Department Captain Greg Fremin expressed significant concern regarding the lengthy timeline of the case. He questioned the reasons behind the two-year delay in the arrest of Banks, especially for a case pertaining to an educator. Fremin noted potential issues in communication or case management, underscoring the gravity of such situations involving minors.

Teaching Certificate Revoked

In a troubling development, it was revealed that Banks' educator certificate had been revoked in 2016. Questions have arisen regarding why Aldine ISD chose to hire him despite this history. The district has yet to provide a response to inquiries about their hiring practices and the oversight in this matter. Meanwhile, attempts to reach the Houston Police Department for further clarification have gone unanswered.

The unfolding situation continues to raise alarm and scrutiny in the community, as parents and stakeholders seek clarity and accountability.

Navigating Legal Options for Students Sexually Assaulted by a Teacher

In the aftermath of alarming cases involving educators and sexual abuse, understanding the legal rights and options available to victims is vital. Anjali Nigam, an experienced Texas sexual abuse lawyer, explores the pathways for accountability and support for those affected. She highlights the complexities of civil lawsuits, the role of school districts, and the importance of timely action in seeking justice.

Editor Darla Medina: What legal options do victims have when they’re abused by a teacher?

Attorney Anjali Nigam: Victims can pursue multiple avenues, including civil lawsuits against the school district and the individual teacher. It’s important to hold both parties accountable.

Medina: Are there statutes of limitations that victims should be aware of?

Nigam: Yes, there are. In Texas, victims of sexual abuse generally have a certain time to file a civil suit. However, it’s vital to seek legal advice as early as possible, given that each case has unique circumstances.

Medina: What role does the school district play in these situations?

Nigam: The district can be held liable if it failed to take appropriate actions when informed of previous misconduct. They have a responsibility to ensure a safe environment for students.

Medina: That's insightful. What message do you want to convey to potential victims or their families?

Nigam: I want them to know that they are not alone and that legal avenues are available to seek accountability and support. Speaking out is a powerful step toward justice.
