Legal Recourse For Victims of Apartment Building Shootings
Attorney contributor Brian Kent of www.crimevictim.Attorney represents violent crime victims in civil cases. Mr. Kent has shared with us his insight on the legal options available to these victims and their families.
“If you own a commercial property, you have a legal duty to maintain the safety of your patrons and employees. In order to do this, property owners must provide adequate security on site. This may include, but is not limited to installing video cameras, hiring security personnel, and providing well-lit parking lots. If a property owner fails to provide adequate security, and a shooting occurs due to their negligence, then the victims may have grounds for a lawsuit,” states Mr. Kent.
“Also, the crime must be proven reasonably foreseeable for the property owner to be considered liable. A reasonable foreseeable crime is one that occurs on a property that had a prior history of criminal violence, yet no security improvements were established. Essentially, if a victim’s lawyer can prove that the crime which injured their client was reasonably foreseeable and only occurred due to inadequate security, then the property owner may be deemed responsible”, explained Mr. Kent.
