Legal Options for People Injured by Drunk Drivers in South Carolina
Brian Kent of CrimeVictim.Attorney represents people who have been injured by drunk drivers, helping them fight for the financial compensation they need and deserve. We’ve asked Brian to contribute some thoughts on the legal options available to these people in South Carolina:
Each state has its own laws which apply to drunk driving accident cases. While every state allows people injured by drunk drivers to file personal injury lawsuits, third-party liability laws vary. In South Carolina and many other states, alcohol vendors can also be held liable for providing alcohol to someone who went on to cause a drunk driving accident with injuries. This second type of lawsuit is called a dram shop claim.
Dram shop claims are only available in certain situations. According to South Carolina’s dram shop policies, people who have been injured by drunk drivers may have the right to sue the alcohol vendor if the vendor served a customer who was visibly intoxicated or to a minor and the intoxication was a cause of the accident.
Determining third-party liability for a drunk driving accident is complicated. If you or someone you love has been injured by a drunk driver, you can learn more about your options for financial compensation by discussing your case with an experienced car accident lawyer.
