Attorney contributor to Legal Herald and founder of BanvilleLaw.com, Laurence Banville had the following insight to share with construction workers who suffer injuries while on-the-job:
“Most people understand that construction work is quite dangerous, though not all truly comprehend why. Indeed, there are countless hazards encountered on project sites, but the most common causes of injuries are heavy machinery, power tools, working at heights, and slip/fall risks.
Some may also believe that, since construction workers know that their jobs are risky, that they then forfeit the right to filing a worker’s compensation claim if they become injured. This could not be further from the truth.
Just as employees in less hazardous industries can file a claim if they become injure while on-the-clock, a construction worker who suffers an injury on a construction site can also file a claim.
This claim will then provide the worker with benefits that cover medical expenses resulting from the injury, and may even cover a portion of lost wages. Most importantly, if the injury causes permanent disability, then the victim can also apply for disability benefits from the Social Security system (SSDI).
Unfortunately, these federal programs that provide compensation can be difficult to navigate. If claims are improperly filed, then victims can receive a small compensation, or no compensation at all, leaving them and their families to deal with the repercussions of the injury by themselves.
This is where the help of an experienced attorney can be crucial. Construction accident attorneys know how to navigate the worker’s comp system and have the experience that allows them to pursue full compensation while their clients can concentrate on what really matters – recovery and healing after their traumatic experience.”
