Massage Therapist Jianxun Xu Accused of Sexually Assaulting 2 Women at Oriental Massage While on Probation

Massage therapist Jianxun Xu will face sentencing on January 24 after pleading guilty to sexually assaulting two women at Oriental Massage at the Commons Mall in Federal Way. At the time of these sexual assaults, Xu was on probation for sexually assaulting another woman at Happy Foot Massage in 2016 and was practicing without a license.

Xu was sentenced to 15 days of electronic monitoring in June 2017 on fourth-degree assault charges for the 2016 sexual assault at Happy Foot Massage. His massage license was also revoked.

While on probation in that case, Xu was hired to work as an unlicensed massage therapist at Oriental Massage in 2018. During his time there, he sexually assaulted two more women in February and March of 2018. He was charged with two counts of fourth-degree assault with sexual motivation and pleaded guilty to both counts.

In November 2019, Xu was sentenced to 349 days in jail for the February 2018 sexual assault. He faces a second sentencing hearing on January 24 for the March 2018 sexual assault. Prosecutors have asked for two more years in jail, while the defense has asked for a six-month jail sentence with sex offender treatment.

Legal Options For Victims of Sexual Assault by Massage Therapists

Attorney contributor Brian Kent of AbuseGuardian.com is a former sex crimes prosecutor who now directly represents sexual assault victims in civil lawsuits. Brian has represented several victims of massage therapist sexual assault. Here are a few of his thoughts on the legal rights of these victims:

The massage industry has a major sexual assault problem, as there have been hundreds of reports of massage therapists sexually assaulting their clients during massages. The owners of massage therapy businesses have a legal duty to do all in their power to protect their customers from sexual predators. But sadly, not all massage therapy business owners fulfill this legal duty.

Some cases of massage therapist sexual assault happen in part due to negligence by the business, such as hiring a massage therapist who has a history of sexual assault charges. In these cases of negligence, massage therapist sexual assault victims may have grounds for a lawsuit against the business where they were assaulted.

For example, if a massage therapy business hired a massage therapist with a past conviction for sexually assaulting a client and that massage therapist goes on to sexually assault another client, that second victim would likely have a strong case for a lawsuit.
