Woman Reports Alleged Sexual Assault at LH Foot Massage in Federal Way

A woman has contacted the police to report being sexually assaulted by a massage therapist at LH Foot Massage in Federal Way, which has now been renamed “Essential Massage.” This is the third reported sexual assault at the business since 2016.

The victim told Federal Way police that a massage therapist inappropriately touched her private area during a massage at LH Foot Massage at around noon on October 29 of this year.

The name of the accused massage therapist has not been released. As of November 19, it is not clear if there has been an arrest. According to the police report, the woman told police that the accused masseur was an Asian male, roughly six feet tall, and about 200 pounds. He was also described as between 50 and 60 years old with short black and gray hair and a round face.

According to Federal Way police Commander Kurt Schwan, this case remains an active felony investigation, which means the department is unable to provide further details.

The first two reported sexual assaults at this business involved two separate victims. 49-year-old Xiaodong Yang was found guilty on January 15 of sexually assaulting two clients during massages at the business in December of 2017 and February of 2018.

The victim from the February 2018 assault won a civil lawsuit against LH Foot Massage after accusing the company of having knowledge of at least two prior complaints of Yang’s sexual misconduct but failing to warn clients or removing Yang. She was awarded $140,000 in July.

Legal Options For Victims of Sexual Assault by Massage Therapists

After working for several years as a sex crimes prosecutor, attorney Brian Kent of AbuseGuardian.com now represents sexual assault victims in civil lawsuits against sexual predators and negligent third parties. Brian has represented several clients in lawsuits against massage businesses for sexual assaults committed by massage therapists. Here are some of his thoughts on the legal rights of these victims:

Trust is essential in the massage therapy industry, as massage therapists are alone with their clients, who are in vulnerable positions. This means that there is a high risk for sexual assault if untrustworthy individuals are working as massage therapists. Sadly, this industry has widespread issues with massage therapists violating the trust of their clients and sexually assaulting them.

Massage therapy businesses have a legal duty to have adequate safeguards in place for preventing sexual assault. When a failure to meet this legal duty allows an employee to sexually assault a customer, the business could be held liable for negligence if the victim decides to file a lawsuit.

For example, a massage therapy business could be considered negligent if there had been previous complaints of sexual misconduct involving the massage therapist but those complaints had gone ignored.
