Are Hospitals Liable For Sexual Assaults At Their Facilities?
Attorney contributor Brian Kent of AbuseGuardian.com is an advocate for sexual assault survivors, helping them find justice in the civil court system. We have asked him for some insight into the legal rights of those who have been sexually assaulted in healthcare facilities:
In any healthcare facility, quality care and the safety of patients and staff need to be the top priorities. But sometimes, terrible crimes like sexual assault occur in healthcare facilities, with both staff members and patients as perpetrators. When a patient is sexually assaulted in a healthcare facility, it’s crucial to make sure they get the support they need and that those responsible for the assault are held accountable.
In some cases, the facility itself is partially responsible for enabling the assault to occur due to negligence. An example might be a failure to properly supervise a psychiatric patient who sexually assaulted another patient. When negligence was a factor in the assault, the victim and their family may have grounds for a lawsuit against the facility.
