Legal Options for Homeless Shelter Sexual Assault Victims and Their Families

As a former sex crimes prosecutor and founding partner of AbuseGuardian.com, Brian Kent understands how both the criminal justice and civil court systems can help sexual assault victims find justice. We’ve asked Brian to add some general information on the legal rights of homeless shelter sexual assault victims:

Homeless shelters have a legal obligation to make sure the people staying with them are safe from preventable harm, including sexual assault. Strong security standards and proper supervision can help greatly reduce the risk of residents becoming crime victims. When a resident is sexually assaulted, it’s important to ask how the assault could have been prevented.

Some cases of homeless shelter sexual assault only happen because of negligence by the shelter, such as failing to properly supervise people staying at the shelter. In cases of negligence, victims of homeless shelter sexual assault may have grounds for a lawsuit against the shelter.
