Legal Recourse For Drunk Driver Accident Victims in Rhode Island

Attorney contributor Brian Kent of CrimeVictim.Attorney helps the victims of drunk drivers get the financial compensation they deserve. We’ve asked him to summarize the legal options available to drunk driving victims and their families in Rhode Island:

In Rhode Island, those who are injured in alcohol-related accidents often have grounds for a personal injury claim against the individual who caused the accident. Additionally, some of these accidents can result in liability for businesses that provided alcohol to the individual responsible for causing the accident. These third-party liability laws are known as “dram shop” laws.

According to Rhode Island dram shop laws, alcohol vendors like bars, restaurants, and liquor stores can be sued by drunk driving victims if the vendor provided alcohol to a minor or a “visibly intoxicated” person who goes on to cause an alcohol-related accident. For example, if a bar customer is slurring their words, stumbling, and clearly drunk, the staff has a legal obligation to stop serving them alcohol. If they continue to serve this customer and that customer causes an alcohol-related accident, anyone injured in the crash (or the victim’s family if the crash is fatal) may have grounds for a lawsuit against the bar.
