Legal Recourse for Shooting Victims and Their Families

Attorney contributor Brian Kent of CrimeVictim. Attorney regularly works with victims of violent crimes at apartment buildings. He is a civil attorney who helps families file private civil cases and has offered his insight regarding the process.

“Property owners and business owners have a legal responsibility to provide security for their residents and visitors. An apartment complex owner can ensure safety by providing safety measures such as well-lit parking lots, video surveillance, and on-site officers. When a property owner fails to provide adequate security, a civil case can be filed alleging negligence.

For plaintiffs to have a successful case, their civil litigation attorney must be able to prove to a court that the property owner was negligent in providing a safe environment. This is to say, they must prove with evidence that the proprietor knew about crime in the area and did not make any changes to avoid a foreseeable crime.

Whether a victim survives or not, there are various costs associated with recovery and loss. Families of the victims usually take care of the expenses related with their loved ones due to the disability that victims often suffer. Through a violent crime lawsuit, victims and their family members can be awarded a monetary compensation that covers the damages suffered. These can include medical expenses, funeral or burial costs, emotional distress and more” explained Mr. Kent.
