A 53-year-old man has been accused of raping a fellow patient at Community Assessment – an in-patient drug and behavioral health treatment facility on the 8400 block of Broadway Avenue. Eugene Clark has been charged with rape and is being held in the Cuyahoga County Jail while awaiting a court appearance.
According to the police report, the incident occurred at around 4:45 p.m. on January 12 at the Community Assessment Center. A 58-year-old man told the police that he decided to skip dinner and take a shower in one of the facility’s bathrooms instead. After he entered the bathroom, Drake allegedly entered the bathroom as well and raped him.
The alleged victim left the facility out of fear, according to police reports. He gave police the clothes he was wearing when the assault occurred and had a sexual assault examination at MetroHealth.
Legal Recourse for Survivors of Sexual Assault at Treatment Centers
Attorney contributor Brian Kent of AbuseGuardian.com represents survivors of sexual assault in civil lawsuits, helping them fight for the justice and support they deserve. Here are some of Brian’s thoughts on the legal options available to those who have been sexually assaulted at drug treatment centers, psychiatric facilities, and other healthcare facilities.
When operated responsibly, drug and mental health treatment centers provide a major service to their communities. However, management in these facilities must make sure that their patients are safe. In some drug treatment facilities, a lack of proper safety measures can result in patients becoming victims of sexual violence or other crimes. When this happens, it’s important for the victims to be aware of their legal rights.
For example, a drug treatment center might be considered negligent for the sexual assault of a patient for hiring new employees without conducting background checks, inadequate security, improper supervision, etc. In those cases which involve negligence, the victims may have grounds for a lawsuit against the facility.
