Multiple Families Say They Reported School Security Guard For Sexual Assault
At least two families claim to have reported the East Technical High School security guard accused of raping students before his arrest, according to a report by ABC News 5 Cleveland. 29-year-old Derrick Dugger was indicted on two counts of rape, two counts of sexual battery, and one count of importuning last Monday, December 3.
But one student says she reported Dugger to the Cleveland Metropolitan School District months before he was arrested. The family of another alleged victim says they reported Dugger to the Cuyahoga County Board of Developmental Disabilities and The Help Foundation, who filed reports with the Cleveland Heights Police. in 2013.
Dugger worked for the CMSD for less than a year and was hired in December 2017. Prior to that, he was employed as a security guard for a private company. Before that, he worked for The HELP Foundation, which is a nonprofit organization that helps individuals with disabilities.
Police believe that there are at least three victims from East Technical High School, but that there could be more out there who have not yet come forward. The investigation began in November, but a CMSD report of a sexual assault complaint was dated September 7.
Legal Recourse School Child Sexual Abuse Victims and Their Families
Attorney contributor Brian Kent of AbuseGuardian.com has experience helping sexual assault survivors in both criminal and civil courts. After beginning his career as a sex crimes prosecutor, he now represents survivors in civil lawsuits. Here are a few of Brian’s thoughts on the options for legal recourse available to those who have been sexually abused by school employees:
Student safety needs to be the top priority for any school, as our schools need to be nurturing environments. But the tragic reality is that, like other places that involve working with children, jobs in schools sometimes attract sexual predators who use their positions of trust as a means to commit heinous crimes. We regularly see this in the news with school employees like coaches, teachers, and security guards being arrested for sexually abusing students.
When children come forward about sexual abuse, it’s crucial to make sure they get all of the support they need and that their abuser is put behind bars. But we also must determine if the school was negligent in a way that failed to prevent the abuse, such as failing to report previous allegations of sexual misconduct to law enforcement. In cases involving negligence, the victims and their families likely have a strong case for a lawsuit.
