Legal Options Available to Victims of Apartment Building Shootings and Their Families

Attorney contributor Brian Kent of crimevictim.Attorney specializes in apartment shootings and works to restore justice to the victims and their families in civil lawsuits. Below Mr. Kent has provided some legal advice on the matter.

Commercial property owners, and in this case apartment building owners, have a legal obligation to protect all of their employees and patrons from preventable dangers on the premises. By providing adequate security on site, property owners are able to protect their customers from harm. But if an apartment building owner fails to offer adequate security (i.e. video surveillance) and someone is injured by a shooting on their property, the building owner here could be held liable for negligent security.

Nonetheless, many of these cases are complex because they stretch beyond the mere issue of inadequate security. In fact, a violent crime victim’s attorney must be able to prove that the crime was reasonably foreseeable. This means that if an apartment building owner received reports of increased shootings in the surrounding area, did nothing to improve security, and then someone was shot outside the complex, the owner here may be held liable.
