Can Restaurant Owners Be Liable For Stabbings On Their Property?

Attorney contributor Brian Kent of https://crimevictim.Attorney represents restaurant stabbing victims and their families in civil lawsuits. Mr. Kent has shared his knowledge on the legal options open to these victims.

Owners of commercial properties must maintain the safety of those who visit their property. In order to do so, the owners must provide adequate security to prevent any violent crime from injuring their patrons or employees. This may include installing security cameras or hiring security guards. A property owner may only be held liable for a crime if it was considered reasonably foreseeable. An example of a reasonably foreseeable crime would be if a stabbing occurred at a restaurant with a prior history of criminal violence, but the security was not improved.

Additionally, in order for a restaurant owner to be seen as responsible for a violent crime, the victim’s lawyer must prove that the crime only occurred due to inadequate security. Providing negligent security could leave a restaurant owner partially liable for a crime. Essentially, if a reasonably foreseeable crime occurs at a restaurant due to inadequate security, then the victims may have grounds for a lawsuit against the property owner.

If you or a loved one has been a victim of a restaurant stabbing you can learn more about your legal options by speaking with an experienced crime victim attorney.
