Can Restaurant Owners Be Liable For Violent Crime on Their Properties?

Attorney contributor Brian Kent of crimevictim.Attorney works closely with victims injured in restaurant shootings. Mr. Kent provides his legal advice on the options available to these victims and their families.

If you own a commercial property such as a restaurant or a bar, you are required by law to provide adequate security. This may include having security guards, video surveillance, and well-lit parking lots. When a property owner fails to fulfill this legal duty and someone is injured by criminal violence due to their negligence, then the victims may have grounds for a lawsuit against the property owner.

To add to this, the violent crime must be deemed reasonably foreseeable in order for the victim to have a lawsuit against the property owner. A reasonably foreseeable crime could be if a shooting occurred at a restaurant with a history of violent crime, yet no security improvements were established. In order for a restaurant owner to be considered liable for a shooting, the crime must have been reasonably foreseeable and have only occurred due to their security negligence.

If you or someone you love has been victim to a restaurant shooting, you can discuss your legal options with an experience crime victim lawyer.
