Texas State Laws On Campus Sexual Abuse

In May 2017, Texas legislators passed two bills which institute new requirements for how universities must handle campus sexual assault:

Senate Bill 968 allows students and university employees to electronically and anonymously report sexual assaults to their universities.

Senate Bill 969 grants amnesty to students who report sexual assault, even if they were committing other crimes, like underage drinking or drug use.

Legislators hope these laws will make it easier for students to report sexual assault without fear of repercussions.

University Of Texas Student Sues Over Sexual Assault Policy

A University of Texas student is suing UT President Greg Fenves over the school’s sexual assault policy – claiming that he was unfairly suspended for five semesters even though his accuser verbally agreed to have sex with him in April 2016.

The student claims his accuser decided days later that she was too drunk to consent to the sex and filed a report with the school’s Title IX office.

The male student was cleared of any wrongdoing in a university disciplinary hearing. But the woman appealed to the university’s president. His lawyer claims he did what he was taught to do – verbally ask for consent, and that the accuser said yes. The student wants to return to the university and have his name cleared of any wrongdoing.

Federal Title IX Guidelines For Universities

Title IX sets several mandatory guidelines that universities must follow when a student files a complaint about sexual misconduct:

  • Universities must have a designated Title IX coordinator, who is appointed and publicly identified
  • They must publish a policy which prohibits discrimination based on sex or gender
  • Institute grievance procedures
  • Investigate all complaints
  • Make sure victims have access to support systems (like counseling)

While all universities are required to meet these guidelines, some states and schools have also instituted their own laws regarding campus sexual assault. What Are The New Title IX Changes?

In September of 2017, the Department of Education released an update to Title IX requirements. This “Dear Colleague Letter” outlined changes which the department claims will provide the accused with more rights. Previously, critics argued that the disciplinary process was biased against accused students and denied them due process, as the universities were required to resolve complaints within 60 days. This meant that many accused students didn’t have enough time to build a successful defense to the accusations.

The Dear Colleague Letter lifted this time limit, and now schools have unlimited time to resolve complaints. This means that students now have more time to work with lawyers and gather evidence which could prove their innocence in a disciplinary hearing. Schools also must notify accused students with a written notice of the investigation at the beginning, including details of the allegations against them.
