Disciplinary action for sexual misconduct violations under Title IX can seriously jeopardize your future. Students who are found responsible for these violations may face serious penalties which could interfere with their college careers and professional opportunities. If you’ve been accused of sexual harassment or sexual assault on a college campus, you should be aware that potential consequences may include:

  • Suspension and expulsion
  • A permanent recording for sexual misconduct on your transcript
  • Possible involvement from law enforcement and criminal charges
  • A damaged reputation as a sexual predator
  • Difficulty finding work if and when you graduate

The disciplinary process for allegations of college campus sexual misconduct varies between universities. In some cases, accused students are denied certain aspects of due process. Universities who fail to properly investigate claims of sexual misconduct may lose their federal funding, which gives them an incentive to immediately side with accusers. In many cases, these schools push to finish investigations quickly and find accused students responsible in order to protect their funding and their reputation.

If you’re a student or the parent of a student who’s been accused of sexual misconduct, it’s important to do all that you can to protect your legal rights. Our Ohio Title IX defense lawyers can act as your adviser and help you prepare for your hearing. We’re prepared to help you protect your future and exonerate yourself.

How Can A Title IX Defense Lawyer Help?

In Title IX disciplinary proceedings for alleged sexual misconduct, both parties have the option to choose a Title IX adviser. This person should be someone you trust and their responsibility is to offer you guidance and support throughout the process. Some students decide to choose a teacher or coach they have a strong relationship with. However, students accused of sexual misconduct also have the option to choose a lawyer.

Unlike criminal hearings, your lawyer may not speak on your behalf during any meeting. However, he or she can help you in other ways, such as:

  • Investigating the allegations against you
  • Interviewing witnesses
  • Collecting evidence
  • Taking notes during your hearing
  • Coaching you on what to say during your hearing
  • Uncovering violations of Title IX protocol and holding the school responsible

The burden of proof in a Title IX hearing is lower than a criminal trial. Only a preponderance of evidence is necessary for a conviction, which means the evidence suggests it’s more likely than not that the allegations are true. A lawyer who specializes in campus sexual assault defense is often necessary to ensure that this preponderance of evidence standard is not met.

Changes Under The 2017 Dear Colleague Letterohio state lacrosse players

In September of 2017, the Department of Education issued a new Dear Colleague Letter, which made some changes to the Title IX requirements for federally-funded colleges and universities:

  • Schools have the option to use the preponderance of evidence standard or the convincing evidence standard
  • Both students may have the option to appeal rulings
  • The choice to institute informal resolution methods (like mediation) if both parties agree
  • Accused students must receive written notice of the allegations against them
  • Accused students must be provided adequate time to prepare a response before the initial interview
  • Provide concurrent written notification of the ruling to both parties

As you can see, several of these new changes are optional. Schools still have control over how they handle these allegations. A Title IX defense lawyer who specializes in Ohio Title IX cases can give you a better idea of what to expect from your school’s disciplinary process.
