Can Parking Lot Owners Be Held Liable For Stabbings On Their Properties?

Attorney contributor Brian Kent of crimevictim.Attorney represents victims of violent crimes in civil cases and below we have asked him to share some of his advice on the legal options available to parking lot stabbing victims and their families.

“Generally speaking, commercial property owners are legally obligated to ensure the safety of their customers and employees. To keep patrons safe from preventable crime, property owners must supply adequate security on the premises. However, there are times when security is inadequate and causes someone to be injured in a stabbing or another violent crime. Under these circumstances, the victim may have grounds for a lawsuit against the property owner,” states Mr. Kent.

He explains further, “Additionally, a violent crime victim’s attorney needs to be able to prove the crime reasonably foreseeable. Essentially if a property owner knows about rising crime in their area and does not improve security on site, then he or she may be held liable for the reasonably foreseeable crime inflicted on the victim. Overall, inadequate security and a reasonably foreseeable crime must be proven together for a violent crime victim to have a valid lawsuit against the property owner.”

If you or someone you love has become a victim to a violent crime, you should reach out to an experienced crime victim lawyer to discuss your potential legal options.
