Legal Recourse For Teacher Sex Abuse Victims and Their Families

Attorney contributor Brian Kent of AbuseGuardian.com is a former sex crimes prosecutor who now represents sex abuse victims and their families in civil lawsuits. Here are some thoughts from Brian on the legal options available to those who have been sexually abused by teachers and other school employees:

Sadly, sexual predators are often found working from positions of trust – including as teachers and other school employees. Our schools must take the threat of these predators seriously and must do all in their power to protect their students from being sexually abused. But tragically, sexual abuse of students by teachers is a major problem affecting schools throughout the country.

It goes without saying that sexual predators must face criminal penalties for their terrible crimes. Additionally, schools that fail to protect their students also deserve to be held accountable for enabling abuse through negligence. School sex abuse victims and their families may have grounds for a lawsuit against the school district if negligence played a role in the abuse – such as failing to respond to previous complaints of inappropriate behavior by the accused teacher.
